Terms of Service

1. Acceptance of Terms

By accessing or using the Treya application and website ("Service"), provided by Kovio GmbH ("we", "us", "our"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.

You must be at least 16 years old to use Treya, in accordance with the Swiss nDSG and EU GDPR.

2. Description of Service

Treya is a premium strength training application that provides tools to create workout plans, track exercises, log health metrics, and connect with a community of lifters.

3. Beta Program

Treya is currently in a closed beta (invite-only) phase. By participating in the beta program, you acknowledge that the Service is provided "as is" and may contain bugs, errors, or inaccuracies. Features may be modified, suspended, or removed at any time without prior notice.

4. Account Registration

To use the app, you must register for an account. You agree to provide accurate, current, and complete information and maintain the security of your password. You are responsible for all activities that occur under your account.

You retain all rights to the personal and health data you log within Treya. How we collect, use, and protect this data is detailed in our Privacy Policy. By using the Service, you consent to our data practices as described therein.

7. Acceptable Use

You agree not to use the Service to:

• Violate any local, national, or international laws.
• Harass, abuse, or harm other users within the community features.
• Upload malicious code, viruses, or attempt to disrupt the Service.
• Scrape, reverse-engineer, or attempt to extract source code or data from the app.

8. Intellectual Property

While you own the data you input, Kovio GmbH retains all rights, title, and interest in the Treya app, website, original content, features, design, and functionality. You may not reproduce, distribute, or create derivative works without our express written permission.

9. Limitation of Liability

To the maximum extent permitted by applicable Swiss law, Kovio GmbH shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from your access to or use of, or inability to access or use the Service.

10. Termination

You may terminate your account at any time. Upon account deletion, all your personal data will be permanently deleted in accordance with our Privacy Policy. We reserve the right to suspend or terminate your account if you violate these Terms of Service.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes via the app or email. Continued use of the Service after changes constitute acceptance of the new Terms.

12. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Switzerland. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of the Canton of Schwyz, Switzerland.
